Court allows Wood to attend county meetings

October 27, 2009

The 13th Judicial District Court today issued a temporary restraining order and preliminary injunction allowing Mike Wood, an outspoken citizen banned from Valencia County Commission meetings, to continue attending those meetings.

The commission’s next meeting is on November 4. A court hearing is scheduled for November 9.

The court found that Wood “may suffer irreparable injury” if not allowed to attend the meetings and has a constitutional right to address the commissioners, as long as he does so in a way that follows “custom, practice and policies set by” the county for all citizens.

The court ordered the county to cease “forcibly removing or causing to remove” Wood from meetings unless he violates criminal law. Wood can’t be treated differently than any other citizen at meetings.

The court documents show the case as Michael Wood v. Pete Rael, Georgia Kirkham, David Medina, Donald Holliday, and Ron Gentry, also referred to as the Board of County Commissioners.
